Apple Agrees to Pay $500M to Owners of Older iPhone Models

Apple $500M Settlement

Apple has agreed to pay a settlement of up to $500 million, following a lawsuit which accused the company of intentionally slowing down the performance of older phones to encourage customers to buy newer models or batteries.

Apple did not admit wrongdoing. As part of the settlement, the company will pay $310 million to $500 million, including about $93 million to lawyers representing consumers.

Apple customers said their phone performance slowed down after they installed Apple software updates. The customers contend that Apple’s software updates intentionally degraded the performance of older models to encourage customers to unnecessarily upgrade to newer models or install new batteries.

Lawyers for Apple said at the time that the problems were mainly due to high usage, temperature changes and other issues and that its engineers tried to address the problems as quickly as possible.

The preliminary proposed settlement was disclosed on Friday and it would provide a payout of $25 per phone to affected consumers. The settlement still needs to be approved by U.S. District Judge Edward Davila, who oversaw the case brought in San Jose, Calif. The amount each user receives could increase or decrease depending on how many claims are filed. It can also vary based on any additional legal fees and expenses approved by the court.

iPhone users who were named in the class-action lawsuit will get up to $3,500 each.

iPhone users in the United States can file settlement claims if they owned an iPhone 6, 6 Plus, 6S, 6S Plus, 7, 7 Plus or SE device bought before December 21, 2017. The company has yet to share information on where or how consumers can file their claims for this Apple $500M settlement.
