Atkins Nutritionals Settlement
Plaintiffs and Atkins Nutritionals have agreed to settle a class action lawsuit to avoid the cost and risks of a trial. Those who are eligible can receive 25% of the purchase price for all products with proof of purchase. Otherwise you are limited to 10%, up to $100. There’s a total fund of $6.8 million available.
The lawsuits allege that Atkins Nutritionals’ representations related to its labeling, marketing, advertising, and sales of its products that contained any sugar alcohol (including but not limited to maltitol) or polyol (including but not limited to glycerin) were unfair, deceptive, and/or unlawful because, according to the plaintiffs, Atkins Nutritionals’ statement that sugar alcohols have a minimal impact on blood sugar is not accurate.
Eligibility
You are a part of the settlement if you purchased Atkins products that contained any sugar alcohol (including but not limited to maltitol) or polyol (including but not limited to glycerin) during the Purchase Period. The Purchase Period is from January 1, 2013 to the present for purchases in New York, Missouri and/or California, and from January 1, 2014 to the present for purchases in any other state.
Potential Payout
- Class Members who can provide a receipt or other proof of purchase can receive 25 percent of the purchase price of the product. There is no limit to the number of products that can be claimed with proof of purchase.
- Class Members without proof of purchase can receive 10 percent of the purchase price of the product and are limited to $100 in reimbursement.
