Groupon Class Action Settlement
Deal sites like Living Social and Groupon have now matured, but it took awhile. In the beginning when your purchased certificate expired, you were out the money. That of course didn’t sit well with many people and a class action lawsuit was filed in 2011. That lawsuit was settled in 2012, however that settlement was thrown out this year and a new one has been reached.
Who Is Eligible
If you purchased a Groupon Voucher between November 1, 2008 and December 1, 2011, you may be eligible for benefits from the settlement.
Proposed Settlement
Groupon has agreed to pay Eight Million, Five Hundred Thousand Dollars’ ($8,500,000) worth of (1) Groupon Credits to be paid into the Groupon accounts of Settlement Class Members, and (2) cash for Claims Administration Expenses, including Class Notice Expenses, and Attorneys’ Fees and Expenses and Class Representative Awards.
If you are a Settlement Class Member and you submit a timely Claim form, you may be entitled to receive Groupon Credits equal to 130% of the Customer Purchase Price of your original, unredeemed, unrefunded Groupon Voucher(s). That amount may be adjusted up or down depending on the amount of valid Claims that are received and the amount remaining after payment of Claims Administration Expenses, including Class Notice Expenses, and Attorneys’ Fees and Expenses and Class Representative Awards.
Important Dates
- Deadline to submit claim form to obtain Groupon Credits pursuant to the Settlement Agreement: January 9, 2016
- Deadline to withdraw claim submitted under 2012 Proposed Settlement Agreement: January 9, 2016
- Deadline to opt-out of Settlement Agreement: January 15, 2016
- Deadline to object to Settlement Agreement: January 15, 2016
- Date of Approval Hearing: February 26, 2016
- Deadline to use Groupon Credits: 9 months from date of issuance into your account
Analysis
I know I cover Groupon deals from time to time on this site, so I thought this may actually be worth covering here. Personally I qualify for this class action since I did have a couple of certificates expire back when I began using the site many years ago. I suspect many of you might be in the same boat.
If you had unredeemed and expired certificates between November 1, 2008 and December 1, 2011 then you will receive 130% of their value as Groupon credit as part of this settlement. Of course the attorneys get real cash as part of the settlement as well. 🙂
Conclusion
As an eligible member of the class for this Groupon class action settlement, I went ahead and filed a claim. You do have to go back through your account and list the eligible vouchers, so this isn’t as easy as other class action claims. The settlement is asking for the Groupon Voucher Barcode Number and Groupon Voucher Purchase Number. I tried to download the example pdf’s but they didn’t work. My Groupons show a Voucher number and a Groupon number. Does anyone know which one goes in which column?

Got the email and glanced over it. As usual, the lawyers are the only winners.

To find out if you have eligible, expired groupons, log in to your account, go to my groupons, limit listing to credit vouchers from all (not expired like I’d expect).
It will give you the expired groupons and purchase dates. From there, you can see if any fit the settlement criteria and get the ID info.
