Lawsuit Filed Over Missing Rewards for Capital One Offers

Capital One is facing a new lawsuit which accuses the company of withholding promised cashback rewards.

Plaintiff Alan B. McNichols filed a class action lawsuit against Capital One Bank N.A., Capital One Shopping Holdings LLC and Capital One Financial Corp. accusing them of failing to honor Capital One Offers. This class action lawsuit was filed in Virginia federal court.

The lawsuit alleges that “Capital One regularly failed to provide cardholders with the payout that they had been promised in the offer after the cardholders made purchases in reliance on the offer”.

Mr. McNichols says that Capital One failed to provide the cashback rewards despite representing to consumers that they would be available within 45 days of a purchase.

The Capital One class action lawsuit is McNichols v. Capital One Bank N.A., et al., Case No. 1:26-cv-00145, in the U.S. District Court for the Eastern District of Virginia.

  1. I’ve had the same issue clicked on offers made purchases and never received an ounce of cashback from the offers. I’ll just stick with the normal cashback sites.

  2. Seems like an open and shut case. Either they bank did or did not screw up. I have not seen the complaint, but I would not be surprised if the account agreement requires arbitration and if so, that could knock out a class action lawsuit.
