Kroger Data Breach Settlement, $18 to $5K Payout for Eligible Class Members

Consumers whose information may have been compromised during a Kroger data breach could be eligible for payments up to $5,000 thanks to a class action lawsuit settlement. Kroger has not admitted to any wrongdoing, but has agreed to the settlement to avoid additional costs. The total settlement fund is $5 million.

The breach exposed personal data and protected health information (PHI). The sensitive data of around 1% of Kroger Health and Money clients were stolen.

Kroger was one of the affected entities after the cyberattack on the File Transfer Appliance (FTA) of Accellion in December 2020. The FTA is a legacy software that is used to transfer files that are too big to be sent through email. Hackers acquired access to the information of over 100 organizations, including Kroger. Kroger has confirmed it is no longer using Accellion FTA.

The Kroger data breach settlement allows Class Members to claim one of the following benefits:

  • A cash payment in an amount to be determined
  • Two years of credit monitoring and insurance services
  • Cash payments of up to $5,000 per Class Member for reimbursement of certain documented losses

The cash payment will vary depending on the number of claims filed. It is expected to be an estimated $36 to $182 for California Class Members and $18 to $91 for everyone else.

Documented losses consist of unreimbursed losses incurred on or after Dec 16, 2020, related to identity theft and fraud and that were likely a result of the Kroger data breach. These losses can include credit card cancellation fees, decline payment fees, overdraft fees, costs associated with purchasing credit reports, and others.

The Class is made up of those who received a notice from Kroger that their personal information was compromised as a result of the File Transfer Appliance (FTA) data breach. Documentation is not required for cash fund payment claims.

The deadline to file a claim is March 5, 2022.

  1. I recieved a letter and filed. Then i got a letter sayin they havnt recieved it. Do i sebt it again and havnt herd anything on the status of the lawsuite, how much for the 2 cash payments, or if my info got filed on time. Am i even getting anything? Where do i go to get this info. I have the letter with all the info needed but dont know where to go.
