Checkers Data Breach Settlement
If you have visited a Checkers or Rally’s in recent years you could be part of a settlement that will get you a $5 voucher or an even larger payout if you incurred any expenses due to a their data breach.
This Checkers and Rally’s class action lawsuit alleged that the restaurant mishandled a data breach. 100 restaurant locations around the country were affected from 2015 to 2019. Class members can get four $5 vouchers or up to $5,000 in expense reimbursement. The breach went undetected for about four years and compromised consumer payment information such as card numbers, verification codes, expiration dates, and more.
The lawsuit alleges that Checkers and Rally’s restaurants should have been aware of the risk of data breach issues due to the increasing threat posed by hackers. As a result of this alleged negligence, countless consumers like the plaintiffs reportedly had their information compromised.
The Settlement is not an admission that Checkers did something wrong, but rather is a compromise to end the lawsuit. By agreeing to settle, both sides avoid the cost and risk of a trial, and people who submit valid claims will get compensation. You can see more details here.
Who is Eligible
You are included in the Settlement Class if you reside in the United States and made a credit or debit card purchase at any affected Checkers or Rally’s restaurant during the period of the Data Breach.

What You Get
If you are part of this class action lawsuit, you are eligible for up to $5,000 in reimbursement for documented out-of-pocket expenses and lost time. Expenses may include bank fees, fraudulent charges, and more. Lost time could have been spent mitigating the effects of the data breach and is reimbursed at a rate of $20 per hour, up to 4 hours.
The settlement alternatively provides vouchers which can be redeemed at any Checkers and Rally’s restaurant. The vouchers are worth $5 each – with up to four vouchers available to each Class Member.
Class Members must file a claim form by Oct. 28, 2020. For reimbursement claims, documentation of expenses and lost time is required.
